The Company

Bessie May, (“The Company”) trading as bessiemay.com. This document is and shall prevail over any other document or communication.

Privacy Policy

We are committed to maintaining the privacy of our customers. Your personal details will remain strictly confidential and we will not disclose your information to any third parties. We may at times contact you, by post, telephone, or email, regarding special offers or with other relevant information. Please also see http://www.bessiemay.com/privacy-policy.

Ordering

Orders can be made by telephone or on-line. You can telephone us on +44 (0)1903 8167088 between 0900 to 1700 GMT Monday to Friday, or e-mail us at mail@bessiemay.com.

Order Dispatch and Delivery

We attempt to dispatch orders as early as possible on confirmation of order agreement. For non customised items that are in stock within 3-5 working days, or 30 working days if not in stock. Customised goods are aimed to be dispatched within 28 working days. Any time or date for delivery stated by the Company shall be treated as an estimate only. No liability can be accepted by the Company for failure to deliver within any specific time period. The Company shall not be liable for any loss or damage whatsoever (including consequential loss or loss of profit) arising directly or indirectly from any delay in the delivery of all or any of the goods howsoever caused. The Company shall accept no liability for shortages or damage to goods unless the Customer reports the fault within seven days post the date of delivery, in writing to mail@bessiemay.com.

We are keen to deliver your order quickly and safely, and for all UK addresses we dispatch by using Royal Mail standard service, with proof of postage for each parcel, so that there is a record of dispatch. We can deliver using Royal Mail Recorded Delivery if there are any concerns about receipt, on request.

For all other deliveries outside of the UK, we utilise Royal Mail Airmail, and Royal Mail Airmail International Signed For.

We reserve the right to withhold delivery to any particular place or location at our sole discretion.

The risk in delivery of goods passes to the Customer as soon as progression of transportation, or where the Customer will not accept delivery, or to the postal/courier service if put in temporary storage.

The Company will not refund customers for orders that are not delivered because the Customer has not accepted delivery, has not responded to delivery cards left by the Postal or Courier Service, has not responded to contact from the Company by telephone, fax or email, or the Customer has not specified particular delivery requirements that could result in non-delivery of orders.

Returns

We hope you are satisfied with your purchase. If for any reason you are not, you may return it in perfect condition, in the original packaging, having informed us within seven days after the delivery date, in writing at mail@bessiemay.com, requesting a returns number. All returns to be received by us at Bessie May, Bessie May Studio, 47 Penlands Vale, Steyning, West Sussex, BN44 3PL, UK, with a confirmed order, invoice and returns number included, within ten days post the date of delivery. Please note, after this time period we are under no legal obligation to accept the return, as stated in The Consumer Protection (Distance Selling) Regulations Act 2000. We will then arrange to exchange the product or make a refund. Please note any refunds will not include postage, packaging or courier charges. For products returned the Customer shall quote the returns number and be responsible for all costs and expenses (including any insurance) of returning the goods to the original dispatch point. The Customer’s payment will be returned within 28 days, subject only to deduction of any direct costs of transport and insurance incurred by the Company in relation to the original shipping and return of the goods upon receipt of the goods and inspection as to their suitability for re-sale.

Customised, bespoke and personalised goods are not eligible for return unless the goods arrive in a faulty condition, or the customisation does not match the specifications provided at the point of sale.

Due to copyright reasons, books, patterns or magazines are non returnable.

If goods are damaged during delivery, these will be replaced, inclusive of delivery costs to return the damaged items, only on receiving notification in writing at mail@bessiemay.com within seven days after the day of delivery. Failure to notify us in writing as stated, with a description of the damage and requesting a returns number, in accordance with these terms and conditions, it will be deemed that the goods have been accepted and are eligible for payment. Replacement goods will be dispatched on receipt of those damaged, which should be returned within ten days of receipt, with the returns number, and detail of damage, to the Bessie May Studio.

Cancellation of an Order

If a customer cancels an order, written notice must be given to mail@bessiemay.com by the Customer within seven days from the day on which the goods are received by the Customer, detailing the order and invoice number, and requesting a returns number. The Company is not obliged to take return of any item where notice is given outside this period. For products returned the Customer shall quote the returns number and be responsible for all costs and expenses (including any insurance) of returning the goods to the original dispatch point, being in perfect order and in original packaging. The Customer’s payment will be returned within 28 days, subject only to deduction of any direct costs of transport and insurance incurred by the Company in relation to the original shipping and return of the goods upon receipt of the goods and inspection as to their suitability for re-sale.

The Company reserves the right to cancel an order received, if there is insufficient stock to deliver the goods, there is no delivery to the Customer’s area, or there is an incorrect pricing shown on the order due to an error being displayed on the Bessie May website, or from an error of pricing from a supplier. The Customer will be informed by email and will be refunded via the credit card deducted from as soon as possible, but no longer than 28 days of order receipt. No additional compensation will be applicable.

Acceptance of Orders

No order placed by the Customer shall be deemed to be accepted by the Company, until the Company issues a final acceptance e-mail of the order to the customer, unless otherwise varied by an agreement in writing. Colours and finishes shown on our website are approximations of the actual colours and finishes. All sizing, needles and tension guides provided on the website and on products are approximations, and the Customer is accountable for checking and doing appropriate tension swatches and making adjusments accordingly.

Prices and Payment Methods

Prices are correct at time of uploading the website and the goods are invoiced at the prices ruling at the time of acceptance of an order. Charges are made for all delivery options except where detailed otherwise. The Company reserves the right to change and amend the prices in orders which have not been accepted. The Customer can view shop prices in pounds sterling, euros and american dollars. Such displayed prices are indicative only, and may not equal the actual costs that are billed by the Customer’s bank or card company, when converting the UK sterling amounts to the Customer’s local currency.

Payment is made through SagePay, or PayPal, which are both secure payment processors and our preferred payment methods. We will send you an email to confirm when your order has been processed. The company accepts almost all major credit/debit cards. Full payment is required at time of purchase.

Force Majeure

In the event that the Company is prevented from carrying out its obligations as a result of any cause beyond its control such as, but not limited to, Acts of God, War, Strikes, Lock-outs, Flood and Failure of thirds parties to deliver goods, the Company shall be relieved of its obligations and liabilities for as long as such fulfillment is prevented.

The Company’s Liability

The Company shall under no circumstances whatsoever be liable for any indirect or consequential loss howsoever caused. The Company’s liability in respect of breach or non-performance of any order shall be limited to the invoiced value to which the claim relates. Goods are not tested or sold as fit for any particular purposes or for use under any specific conditions.

Subject as expressly provided in these Terms and Conditions, and except where the goods are sold to a person dealing as a consumer (within the meaning of the Unfair Contract Terms Act 1977), all warranties, conditions or other terms implied by statute or common law are excluded to the fullest extent permitted by law. Where the goods are sold under a consumer transaction (as defined by the Consumer Transactions (Restrictions on Statements) Order 1976) the statutory rights of the Customer are not affected by these Terms and Conditions.

VAT

All our products are inclusive of VAT at the current rate as required by UK Law for orders made by customers resident in the European Union (EU). Delivering to an address outside the EU, then VAT will be removed from the costs of goods. The cost of carriage is inclusive of VAT irrespective of the address of the Customer or the delivery address. Our VAT registration number is available upon request.

Trade Mark and Copy Right

All products, product labels, and material, including all images and wording on bessiemay.com are subject to copyright and design right law. You will need our permission to use any material from our website or any of our other marketing material. We take copyright / trademark infringement very seriously and will not hesitate to take legal action if necessary. We also have the right to revoke use of any of our materials at any time. No reproduction of products branded Bessie May may be made or sold by any means. Any example of this, we will not hesitate to take legal proceedings. Breach of our terms and conditions will result in legal action.

Title

The title on the goods does not pass to the buyer until the goods have been paid in full and also all other amounts due from the buyer to the seller however arising.

Contract Law

Purchases on this website or via telephone are from Bessie May, trading as bessiemay.com. The Company is a sole trader. Customers accept that by dealing with the Company they agree to the Terms and Conditions in this website and that any contract formed with the Company will be a contract under and subject to the laws of England whose courts will have exclusive jurisdiction in the determination of any disputes.

If there is an error with our website, we will aim to change any problems or inaccuracies as soon as possible. In the event the products or information we provide results in property, physical, or other harm, we assume no liability. By visiting our site and placing an order you are agreeing to our Terms and Conditions, which are interpreted in accordance with English Law.
